1. Acceptance of Terms

By accessing YouthCPR website, you agree to these Terms and Conditions and all applicable laws and regulations in your state of residence.

2. National Medical Disclaimer & Good Samaritan Laws

  • Educational Context: This site provides education based on national standards (AHA/Red Cross). It does not provide medical advice.
  • Good Samaritan Protections: Users are advised that Good Samaritan Laws vary by state (e.g., California Health & Safety Code § 1799.102 Florida Statutes § 768.13). While most states protect bystanders who act in good faith, The Youth CPR makes no guarantee of legal immunity for users who perform CPR/AED based on these materials.
  • No Certification: This training does not meet the requirements for “State Certified” occupational licensing (e.g., for healthcare providers or lifeguards) unless explicitly stated otherwise by your local state board.

3. State-Specific Liability Limitations

To the fullest extent permitted by law in each respective state:

  • The Youth CPR shall not be liable for any direct, indirect, or incidental damages arising out of your access to or use of the educational materials.
  • Founder Protection: As a youth-led initiative, the founder and volunteers are protected under the Federal Volunteer Protection Act (42 U.S.C. § 14501), which provides certain immunities for volunteers of nonprofit organizations.

4. Intellectual Property & Use License

All content is the property of The Youth CPR. Under this license, you may not:

  • Use materials for commercial gain in any state.
  • Attempt to decompile or reverse engineer any software on the site.
  • Remove any copyright or proprietary notations.

5. Governing Law & Jurisdiction

These terms are governed by the laws of the State of Indiana (where the project is based), without regard to its conflict of law provisions. However, you agree that any legal action must be brought in the appropriate federal or state court.

TERMS AND CONDITIONS

1.  ACCEPTANCE OF TERMS

By accessing the Youth CPR website, registering for, attending, or otherwise participating in any Youth CPR educational session, workshop, training event, demonstration, or online program (collectively, “Program Activities”), you (“Participant”) agree to be fully and legally bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you are under the age of 18, your parent or legal guardian must read, understand, and agree to these Terms on your behalf prior to participation.

These Terms apply to all users across all states and jurisdictions in which Youth CPR operates, including Indiana and all states to which Youth CPR expands, domestically and internationally. State-specific provisions are addressed where applicable throughout this document.

If you do not agree to all of these Terms, you must not access the website or participate in any Program Activity.

Youth CPR reserves the right to modify, update, or revise these Terms at any time without prior notice. Continued use of the website or participation in Program Activities after any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2.  ORGANIZATION OVERVIEW AND EDUCATIONAL PURPOSE

2.1  About Youth CPR

Youth CPR is a student-founded, youth-led non-profit educational organization headquartered in the State of Indiana. The organization provides peer-to-peer educational instruction on Cardiopulmonary Resuscitation (CPR), Automated External Defibrillator (AED) use, and basic First Aid to young people between the ages of 14 and 22. Instruction is provided by a student holding current American Red Cross CPR Instructor credentials. Youth CPR is in the process of expanding its programs to neighboring states and to Florida, with the long-term goal of national and potential international expansion.

2.2  Educational Scope and Alignment with National Standards

All Youth CPR instructional content is developed in alignment with guidelines published by nationally recognized organizations, including the American Heart Association (AHA) and the American Red Cross. However:

  • Content alignment with AHA or Red Cross guidelines does not constitute an endorsement by, affiliation with, or authorization from either organization;
  • Youth CPR is not an authorized training center or licensed affiliate of the AHA or American Red Cross;
  • Instructional content is provided for general awareness and educational purposes only and is not a substitute for official AHA- or Red Cross-certified training courses.

2.3  Non-Certification — National and State-Specific Notice

Youth CPR explicitly and unambiguously does NOT:

  • Confer, award, issue, or imply any official CPR, AED, or First Aid certification of any kind;
  • Satisfy occupational licensing requirements for healthcare providers, lifeguards, childcare workers, teachers, law enforcement, or any other licensed profession in any state;
  • Meet the requirements of any state-mandated certification program unless explicitly confirmed in writing by the applicable licensing authority;
  • Guarantee that any Participant is competent, qualified, or legally authorized to perform CPR, AED use, or First Aid in any professional, employment, or regulatory context.

Any document, attendance record, letter of participation, or certificate issued by Youth CPR reflects educational participation only and has no official certification value for professional, occupational, or legal purposes.

3.  NATIONAL MEDICAL DISCLAIMER AND GOOD SAMARITAN LAW NOTICE

3.1  No Medical Advice

Youth CPR does not provide medical advice, medical diagnosis, clinical instruction, or professional healthcare guidance. All content and instruction provided through Program Activities is general and educational in nature, intended solely to raise awareness of emergency preparedness concepts. Participants should always consult a licensed healthcare professional for any medical question, concern, or emergency.

3.2  Good Samaritan Laws — Multi-State Notice

Youth CPR advises all Participants to be aware that Good Samaritan Laws — which provide legal protections for individuals who render emergency assistance in good faith — exist in all 50 U.S. states but vary significantly in scope, conditions, and application. Youth CPR makes no guarantee, representation, or warranty of legal immunity for any Participant who performs or attempts to perform CPR, AED use, or First Aid in a real-world emergency based on knowledge obtained through Program Activities.

Participants and their families should familiarize themselves with the laws of their specific state. By way of example only (not an exhaustive legal summary):

  • Indiana: Indiana Code § 34-30-12 (Good Samaritan Law) — provides protections for persons rendering emergency care in good faith.
  • Florida: Florida Statutes § 768.13 — provides protections for persons rendering emergency care or treatment.
  • California: California Health & Safety Code § 1799.102 — protects bystanders who act in good faith in an emergency.
  • Illinois: 745 ILCS 49 (Good Samaritan Act) — provides civil immunity for emergency assistance rendered voluntarily and without compensation.
  • Ohio: Ohio Revised Code § 2305.23 — protects persons who render emergency care without compensation.

Youth CPR strongly encourages all Participants to consult a licensed attorney in their jurisdiction for legal guidance regarding Good Samaritan protections applicable to their specific circumstances. The above references are informational only and do not constitute legal advice.

3.3  AED Legal Landscape

Laws governing the use of AEDs by lay rescuers — including registration, liability, and training requirements — vary by state. Youth CPR does not guarantee compliance with any state-specific AED use statute and encourages Participants to review the AED laws applicable in their state or jurisdiction.

4.  ASSUMPTION OF RISK

Participation in Youth CPR Program Activities involves hands-on, physically active demonstrations including but not limited to: practicing chest compressions on training mannequins, practicing rescue breathing techniques, handling AED trainer devices, and participating in simulated emergency scenarios. Additionally, access to the Youth CPR website and online materials carries standard digital risks.

By participating, the Participant (and, where applicable, their parent or legal guardian) voluntarily and knowingly assumes all risks associated with such activities, including but not limited to: physical strain or soreness, allergic reactions to training equipment or materials, emotional discomfort from emergency simulations, and any foreseeable or unforeseeable risk. Participants confirm they are in a suitable physical condition and will disclose relevant health limitations to an instructor prior to participation.

5.  LIMITATION OF LIABILITY, RELEASE, AND VOLUNTEER PROTECTION

5.1  State-Specific Limitation of Liability

To the fullest extent permitted by applicable law in each state in which Youth CPR operates, Youth CPR, its founding members, officers, instructors, volunteers, and agents (“Youth CPR Parties”) shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to:

  • Participation in any Program Activity, whether in person or online;
  • Any injury, illness, or physical harm sustained during any Program Activity;
  • Any action, inaction, or outcome in a real-world emergency by any Participant, whether or not related to Program Activities;
  • Reliance on any information, technique, or instruction provided through Program Activities;
  • Any technical errors, omissions, or inaccuracies in educational content.

5.2  Federal Volunteer Protection Act

In addition to any state-level protections, the founder and all volunteers of Youth CPR are entitled to protections under the Federal Volunteer Protection Act (42 U.S.C. § 14501 et seq.), which provides qualified immunity to volunteers of non-profit organizations acting within the scope of their responsibilities, subject to applicable conditions and limitations. This federal protection applies in all states in which Youth CPR operates, to the extent permitted by law.

5.3  Release of Claims

By participating in any Program Activity, the Participant (and, where applicable, their parent or legal guardian) knowingly and voluntarily releases and forever discharges Youth CPR Parties from any and all claims, demands, actions, or causes of action arising from participation in Program Activities, to the fullest extent permitted by applicable law in the relevant jurisdiction.

5.4  Indemnification

The Participant agrees to indemnify, defend, and hold harmless Youth CPR Parties from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) misuse or misrepresentation of knowledge, skills, or materials obtained through Program Activities; (b) violation of these Terms; (c) the Participant’s acts or omissions in any emergency or non-emergency situation; or (d) any false claim of official certification by the Participant.

6.  AGE REQUIREMENTS AND PARENTAL CONSENT

6.1  Eligible Participants

Program Activities are designed for individuals between the ages of 14 and 22. Youth CPR reserves the right to decline participation to any individual outside this range or who otherwise does not meet participation requirements.

6.2  Minor Participants (Under Age 18) — All States

For Participants under the age of 18, a parent or legal guardian must, prior to participation:

  • Review and agree to these Terms and the Privacy Policy on behalf of the minor;
  • Provide signed written consent via any applicable event consent form;
  • Acknowledge the non-certification nature of Program Activities;
  • Accept responsibility for the minor’s conduct during Program Activities.

In states where additional minor-specific consent requirements exist, Youth CPR will endeavor to comply with all applicable state laws. Youth CPR will not knowingly allow a minor to participate without documented parental or guardian consent where required.

6.3  COPPA Compliance

Youth CPR does not knowingly collect personal information from children under the age of 13 without verifiable parental consent, in compliance with the Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq. Parents who believe their child has registered or provided information without proper consent should contact Youth CPR immediately.

7.  INTELLECTUAL PROPERTY AND USE LICENSE

All content, curricula, handouts, presentations, graphics, logos, website content, and other materials developed by or on behalf of Youth CPR are the intellectual property of Youth CPR and are protected under applicable U.S. and international copyright, trademark, and intellectual property laws.

Participants are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and use materials solely for personal, non-commercial educational purposes. Under this license, you may not:

  • Use any Youth CPR materials for commercial gain in any state, country, or jurisdiction;
  • Reproduce, distribute, publish, sell, license, or sublicense any materials without written authorization from Youth CPR;
  • Attempt to decompile, reverse engineer, or extract source code from any software, platform, or application associated with Youth CPR;
  • Remove, obscure, or alter any copyright notice, trademark, or proprietary designation on any materials;
  • Modify, adapt, or create derivative works from Youth CPR materials without prior written consent;
  • Use Youth CPR’s name, logo, or brand identity in any manner suggesting endorsement, affiliation, or authorization without express written permission.

8.  PARTICIPANT CONDUCT AND PROHIBITED MISREPRESENTATION

All Participants must conduct themselves respectfully and cooperatively during all Program Activities. The following conduct is strictly prohibited:

  • Disruptive, threatening, harassing, or abusive behavior toward instructors, volunteers, or other Participants;
  • Deliberate misuse or damage of training equipment or materials;
  • Recording, photographing, or filming any Participant without their explicit consent;
  • Falsely representing or implying to any person, employer, institution, or authority that completion of a Youth CPR Program Activity constitutes official CPR/AED/First Aid certification from any recognized credentialing body;
  • Using or presenting any Youth CPR attendance document as evidence of official certification for professional, employment, or licensing purposes;
  • Unauthorized use of Youth CPR’s name, brand, logo, or materials;
  • Any behavior that endangers the health, safety, or wellbeing of any individual.

Youth CPR reserves the right to remove any Participant from a Program Activity at any time for conduct that violates these Terms, without refund of any applicable fees.

9.  HEALTH, SAFETY, AND ACCOMMODATION

Participants are expected to arrive at Program Activities in a state of reasonable physical health. Participants experiencing symptoms of communicable illness are asked to refrain from in-person attendance. Youth CPR reserves the right to implement health and safety protocols consistent with applicable public health guidelines.

Participants with known allergies, physical limitations, or medical conditions relevant to hands-on CPR training should disclose such information to an instructor prior to participation. Youth CPR will endeavor to provide reasonable accommodations but cannot guarantee full accommodation in all circumstances.

10.  PHOTOGRAPHY, VIDEOGRAPHY, AND MEDIA RELEASE

Youth CPR may photograph or record Program Activities for educational, promotional, or archival purposes. By participating, you grant Youth CPR a non-exclusive, royalty-free license to use your likeness, image, or voice in such media for organizational purposes, subject to a written opt-out request submitted prior to the event. For minor Participants, this consent is granted by the parent or legal guardian. Youth CPR will not sell or transfer personal images or recordings to third parties for commercial purposes.

11.  DISCLAIMER REGARDING EMERGENCY OUTCOMES

Youth CPR makes no promise, representation, or guarantee that any Participant who attends Program Activities will successfully save a life, prevent injury, or achieve any particular outcome in a real-world emergency. Emergency effectiveness depends on many individual and situational factors beyond Youth CPR’s control. Youth CPR expressly disclaims all responsibility or liability for outcomes — positive or negative — arising from any emergency in which a Participant does or does not attempt to apply knowledge obtained through Program Activities.

12.  WEBSITE USE, DIGITAL ACCESS, AND THIRD-PARTY PLATFORMS

Access to and use of the Youth CPR website is subject to these Terms. Youth CPR makes no warranty that the website will be error-free, uninterrupted, or free from viruses or harmful components. Youth CPR is not responsible for the content, privacy practices, or reliability of any third-party websites linked from the Youth CPR site.

Some Program Activities may be hosted on or registered through third-party platforms (e.g., school portals, event registration services). Participants using such platforms may be subject to additional terms and privacy practices imposed by those third parties. Youth CPR encourages Participants to review those terms independently.

13.  FEES, REGISTRATION, AND CANCELLATION

Youth CPR is a non-profit organization. Program Activities may be offered free of charge or may involve a nominal registration fee to cover operational costs. Fees, if any, will be clearly disclosed at registration. Cancellation and refund policies will be stated at the time of registration and are incorporated into these Terms by reference. Youth CPR reserves the right to cancel or reschedule any Program Activity, with a full refund of any fees paid in the event of cancellation by Youth CPR.

14.  INTERNATIONAL AND FUTURE EXPANSION

Youth CPR anticipates potential expansion beyond the United States. International Participants are advised that these Terms are governed by the laws of the State of Indiana, USA, as described in Section 15. Participants outside the United States are responsible for ensuring their participation complies with all applicable laws and regulations in their country or jurisdiction. Youth CPR makes no representation that its programs or materials comply with the requirements of any non-U.S. jurisdiction.

International Participants should also note that U.S. Good Samaritan laws, liability protections, and volunteer immunity statutes do not extend to conduct occurring in foreign jurisdictions. Youth CPR strongly recommends consulting local legal counsel before applying any knowledge in a professional or emergency context outside the United States.

15.  GOVERNING LAW AND JURISDICTION

These Terms and all matters arising from them shall be governed by and construed in accordance with the laws of the State of Indiana, USA, without regard to its conflict of law provisions. By accessing the Youth CPR website or participating in any Program Activity, you consent to the personal jurisdiction of the state and federal courts located in Indiana for any dispute arising under these Terms.

However, Youth CPR acknowledges that users in other states or countries may have rights under local law that cannot be waived by contract. Nothing in this governing law provision is intended to deprive any Participant of rights they may have under mandatory applicable law in their own jurisdiction.

Any dispute shall first be submitted to informal resolution by contacting Youth CPR directly. If informal resolution is unsuccessful within thirty (30) days, disputes shall be resolved by binding arbitration or through the appropriate court of competent jurisdiction as permitted by law.

16.  SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT

If any provision of these Terms is found invalid or unenforceable under applicable law, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Youth CPR’s failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision. These Terms, together with the Privacy Policy and any event-specific consent forms, constitute the entire agreement between the Participant and Youth CPR regarding Program Activities.

ACKNOWLEDGMENT, CONSENT, AND SIGNATURE FORM

By signing below, the Participant (and, if the Participant is under 18, their parent or legal guardian) confirms that they have read, understood, and agreed to all Terms and Conditions and the Privacy Policy of Youth CPR in their entirety, including all state-specific provisions applicable to their jurisdiction.

The undersigned further acknowledges that:

  • Youth CPR provides educational instruction only and does not confer official CPR/AED/First Aid certification;
  • Good Samaritan law protections vary by state, and Youth CPR does not guarantee legal immunity for emergency response actions;
  • Participation involves voluntary assumption of risks as described in the Terms;
  • Personal information will be handled in accordance with the Privacy Policy and applicable state and federal law;
  • For minor Participants, the parent or legal guardian has provided knowing, voluntary, and informed consent to participation and data collection as described.

1. Information We Collect (By Category)

  • Identifiers: Name, alias, email address, IP address.
  • Protected Classifications: Age (to ensure compliance with COPPA).
  • Education Information: Course progress and quiz scores.

2. State-Specific Privacy Rights

  • California Residents (CCPA/CPRA): You have the right to request the categories of data collected, the right to delete personal information, and the right to “Opt-Out” of any data “sale.” Note: We do not sell your data.
  • Nevada Residents: We comply with SB-220—you may submit a verified request to ensure no future sale of your data.
  • Virginia, Colorado, Connecticut, and Utah Residents: We provide the same rights of access, correction, and deletion as required by your respective state’s comprehensive privacy laws.

3. Children’s Online Privacy (COPPA – All States)

Youth CPR is a platform for teens.

  • We do not knowingly collect personal information from children under 13 without verifiable parental consent.
  • In accordance with the Children’s Online Privacy Protection Act, any parent can request the deletion of their child’s data by contacting our support team.

4. Data Sharing & Third Parties

We do not share your data with third parties for marketing. We only share data with:

  • Service Providers: (e.g., website hosting, email delivery) strictly to operate the site.
  • Law Enforcement: Only when required by a valid state or federal subpoena.

5. “Do Not Track” (DNT) Signals

California law requires us to let you know how we respond to web browser DNT signals. Currently, there is no industry standard, so we do not monitor or take action with respect to these signals.
